Please read these Terms of Service carefully before using MasterPlace. These Terms govern your access to and use of our platform, services, and content.
1. Acceptance of Terms
By accessing, browsing, or using the MasterPlace website and mobile application (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MasterPlace Technologies Private Limited ("MasterPlace," "we," "us," or "our"), a company registered under the laws of India, with its registered office in Pune, Maharashtra.
2. Eligibility & User Accounts
You must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872, to use this Platform. By registering an account, you represent and warrant that all information provided is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify MasterPlace of any unauthorized use of your account or any other breach of security. MasterPlace shall not be liable for any loss arising from your failure to protect your account information.
3. Property Listings & Content
All property listings must be accurate, truthful, and comply with applicable real estate laws including the Real Estate (Regulation and Development) Act, 2016 (RERA). Users posting property listings represent and warrant that they have the legal authority to list the property and that all information provided, including pricing, area, amenities, and photographs, is accurate and not misleading.
MasterPlace reserves the right to remove, modify, or refuse any listing that violates these Terms, is found to be inaccurate, or is reported as fraudulent. Listings for illegal properties, properties under dispute, or properties that violate building codes or zoning regulations are strictly prohibited.
4. Prohibited Activities
Users shall not: (a) post fraudulent, misleading, or duplicate listings; (b) scrape, harvest, or collect data from the Platform without express written consent; (c) use the Platform for spamming, phishing, or distributing malware; (d) impersonate any person or entity; (e) interfere with or disrupt the Platform's infrastructure; (f) circumvent any security features; (g) use automated tools or bots to access the Platform; (h) engage in price manipulation or collusion; (i) violate any applicable law, regulation, or third-party rights.
Violation of these prohibitions may result in immediate account termination and may be reported to relevant authorities.
5. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the compilation thereof, is the exclusive property of MasterPlace or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.
Users retain ownership of content they upload (property photos, descriptions, etc.) but grant MasterPlace a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content on the Platform and in marketing materials for the purpose of providing and promoting the services.
6. Limitation of Liability
MasterPlace operates as a platform connecting property seekers with property owners, agents, and builders. We do not participate in, guarantee, or assume liability for any transaction between users. MasterPlace is not responsible for the quality, safety, legality, or any other aspect of any listed property.
To the maximum extent permitted by applicable law, MasterPlace shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, goodwill, or other intangible losses. Our total aggregate liability shall not exceed the amount paid by you to MasterPlace in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless MasterPlace, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your violation of any rights of another party, or your violation of any applicable law.
8. Privacy & Data Protection
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy. We comply with the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
9. Termination
MasterPlace reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitation of liability.
You may terminate your account at any time by contacting support@masterplace.in. Upon termination, your active listings will be removed from the Platform.
10. Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes may be submitted to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Pune.
11. Changes to Terms
MasterPlace reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. We will notify registered users of material changes via email or in-app notification. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
We recommend reviewing these Terms periodically to stay informed of any updates.
